Terms & Conditions | Beautiful Morning

1. Definitions

Beautiful Morning: Located in Rhoon, Chamber of Commerce (KvK) nr. 24464652, VAT nr. NL002423744B28.
Client: The person or party entering into an agreement with Beautiful Morning.
Parties: Beautiful Morning and the Client together.
Consumer: A client who is an individual acting as a private person.

2. Applicability

These terms apply to all quotes, offers, activities, orders, and agreements for services or products provided by or on behalf of Beautiful Morning.
Changes to these terms are only valid if explicitly agreed upon in writing by both parties.
Any additional or different terms from the client or third parties are expressly excluded.
By booking a service, the client automatically accepts these terms and conditions.
The client is expected to provide all information necessary for the proper execution of the assignment in a timely manner.

3. Bookings & Reservations

Reservation: A reservation means the wedding date is temporarily held, but it is not yet a final booking.
Booking: A booking becomes final once the trial session is scheduled and confirmed by both parties.
Deadlines: If I do not receive a response to a proposal for a trial session within 3 days, the date will be released for other inquiries.
Non-bridal: For non-bridal bookings involving a trial, the client will receive available dates via email within 3 days. The client must choose a date within 3 days of receiving that email.
Responsibility: It is the client’s responsibility to check their email (including the spam folder) and respond on time.

4. Communication

I aim to respond within 24–48 hours to ensure smooth communication.
If a response to an important follow-up question is not received within 3 days, the reservation will automatically expire.

5. Prices

All prices are in Euros, including VAT, and excluding additional costs like travel (€ 0.45/km), travel time fees, parking, or hotel stays, unless stated otherwise.
Beautiful Morning reserves the right to adjust prices at any time.
Estimates (target prices) are used for services. Beautiful Morning may deviate up to 10% from this estimate. If the price increases by more than 10%, I will explain why, and the client has the right to cancel the portion of the assignment that exceeds the estimate plus 10%.
Prices may be adjusted annually. Consumers may cancel the agreement if they do not agree with a price increase.

6. Payments

A down payment of up to 50% may be required upon entering the agreement.
Standard payments must be completed at least 14 days before the appointment.
Last-minute: For bookings made within 21 days of the appointment, immediate payment is required.
Strict deadlines: If payment is not received by the deadline, the client is in default without further notice. Beautiful Morning will not perform the service if the invoice is unpaid.

7. Consequences of Late Payment

If payment is overdue, Beautiful Morning may suspend all work until the balance is paid.
The booking will be cancelled if the client fails to pay.

8. Travel & Expenses

Travel costs: € 0.45 per kilometer from postcode 3162 TA.
Travel time fee: For assignments outside South Holland (Zuid-Holland), a fee of € 25 per 30 minutes (round trip) applies.
Parking, overnight stays, and other travel-related expenses are charged to the client.

9. Execution of the Agreement

I perform my work to the best of my ability and professional standards.
I have the right to involve third parties (colleagues) for the execution of services if necessary.
The client must ensure I can start work at the agreed time. Any extra costs due to delays caused by the client will be charged to the client.

10. Cancellation & Postponement

Booked assignments can be cancelled by the client free of charge. However, payments for services already provided (such as a completed trial session) are non-refundable.
Rescheduling: If you change your (wedding) date, a new booking must be made at the rates currently listed on the website.
If I am unavailable for the new date, the original contract will be cancelled free of charge (excluding non-refundable trial sessions).
Beautiful Morning reserves the right to cancel an assignment in the event of a dispute.

11. Liability

Beautiful Morning is only liable for damages caused by intent or deliberate recklessness.
Liability is limited to direct damages and will never exceed the amount paid out by my professional liability insurance. If the insurance does not cover the claim, liability is limited to the (relevant part of the) invoice amount.
I am not liable for indirect damages, such as loss of profit or damage to third parties.
Images or descriptions on the website are indicative; slight variations do not entitle the client to compensation.
I am not liable for allergic reactions or skin irritations caused by the use of brushes or makeup/hair products.

12. Force Majeure (Unforeseen Events)

I will give 100% effort to fulfill every booking. In case of illness or emergency, I will try to find a replacement of an equivalent level, but this is not a guarantee.
If no replacement is found, the agreement will be partially or fully cancelled.
Force majeure includes war, natural disasters, epidemics, transport strikes, or government restrictions. In such cases, Beautiful Morning is not liable for any compensation or damages.

13. Complaints

The client should inspect the results immediately. If you are not satisfied, please tell me during the session so I can fix it.
Complaints after the fact must be reported within 24 hours (for consumers) or as soon as possible, with a detailed description.
Reporting a complaint does not entitle the client to services beyond what was originally agreed upon.

14. Privacy & Photos

Personal data will not be shared with third parties and is used only by Beautiful Morning.
Photos or videos of my work will only be used on Social Media or my Website with the explicit consent of the client and the photographer/videographer.

15. Changes & Legal Validity

Beautiful Morning may update these terms at any time. Major changes will be discussed with the client in advance.
If any part of these terms is found to be invalid by a court, the rest of the terms remain in full force.
Applicable Law: Dutch law applies to all agreements.
Language Clause: In the event of a dispute regarding the interpretation of these terms, the Dutch text shall prevail.
